Terms of Service

You must provide accurate information and keep your account credentials secure. You are responsible for activity that occurs through your account and must promptly notify us of unauthorized access.

You may use the website only for lawful purposes. You may not interfere with the service, attempt to gain unauthorized access, reverse engineer the website, introduce malicious code, or use the service to infringe another person's rights.

Probabil FM and related products are digital goods. Product descriptions, format support, system requirements, and pricing are shown at checkout or on the product page and may change before a purchase is completed.

A purchase gives you access to download the product and a license to use it under the EULA below. You are responsible for checking compatibility with your system before installing the product.

Payments are processed by our third-party payment provider. Your order is complete when payment is authorized and we provide confirmation or access to the product. Any applicable taxes may be added at checkout. Delivery and withdrawal rights for digital content are described in our Refund & Withdrawal Policy.

After successful payment, we may provide a download link, account access, and a license serial. You must keep your account and serial secure and must not share them with others.

Probabil FM may contact our license API to verify that a serial was issued and remains active. A serial that is invalid, revoked, expired, or used in breach of these Terms may be refused or disabled, subject to mandatory consumer rights.

Refunds, statutory remedies, and any applicable right of withdrawal are governed by our Refund & Withdrawal Policy. Nothing in these Terms removes rights that cannot legally be excluded.

The website, Probabil FM, its software, documentation, artwork, branding, and other content are owned by Probabil Audio or its licensors and are protected by intellectual-property laws. These Terms do not transfer ownership to you.

You may not copy, resell, redistribute, sublicense, publish, or make the product or its installers available to others except as expressly permitted by the EULA.

The service may link to or depend on third-party services. Those services are governed by their own terms and privacy policies, and Probabil Audio is not responsible for their availability or operation.

The service and products are provided on an 'as available' basis. To the maximum extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation.

To the maximum extent permitted by law, Probabil Audio will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or business. Our total liability for a claim relating to the service will not exceed the amount you paid for the relevant product or service during the applicable period. Nothing in these Terms limits liability or consumer rights that cannot legally be limited.

Consumers in Romania may access the Alternative Dispute Resolution procedure made available by ANPC through the official SAL platform at reclamatiisal.anpc.ro.

The European Online Dispute Resolution (SOL/ODR) platform was discontinued on 20 July 2025 under Regulation (EU) 2024/3228. The European Commission's consumer-redress information page remains available for guidance on the current framework.

We may suspend or terminate access when reasonably necessary for security, legal compliance, misuse, or a material breach of these Terms. Provisions that by their nature should survive termination will remain in effect.

We may update these Terms as the service changes. We will post the revised version on this page and update the date below. Continued use after the effective date means you accept the updated Terms.

These Terms are governed by the laws applicable to the operator's registered office in Romania, without excluding mandatory consumer protections that apply in your country of residence. Subject to those protections, disputes may be brought before the competent courts of Bucharest, Romania.
